There are several types of temporary residence permits. First of all, it is a uniform temporary residence permit, which gives the right to work for an employer indicated in the decision on a temporary residence permit, as well as temporary residence issued on a different basis, e.g. in connection with running a business, marriage with a Polish citizen, merger with family, taking up work or study, or residence for foreigners who meet the criteria for obtaining the so-called EU Blue Card.

An application for a temporary residence permit as well as any other application for legalization of stay in Poland should be submitted to the Voivode competent for the foreigner's place of residence.

Remember that you must submit the application no later than the last day of your legal stay in Poland. If submitting the application to the Provincial Office in person is not possible, send the application by registered mail and wait for a request from the Provincial Office to submit fingerprints.

Submitting an application for a residence permit requires submitting many documents. The basic documents without which your application will not be considered are the application form, a copy of your passport, four biometric photos, the stamp duty on the application and Annex No. 1, necessary in the case of an application for a temporary residence and work permit. - immediately before submitting the application, you were employed for 3 months with the same employer and in the same position on the basis of a declaration of entrusting work to a foreigner. In this situation, you will be obliged to present the above. declaration, employment contract and documents confirming payment of social security contributions;

- you have been staying in Poland legally and continuously for 3 years;

- 3 years before submitting the application, you graduated from a university in Poland, another EEA country or Switzerland, or you are a doctoral student in Poland;

- you are exempt from the obligation to have a work permit

• a document confirming that you have a place of residence (e.g. registration certificate, apartment rental agreement or a statement from the owner of the premises that you can live there);
• employment certificate from your last employer (if you previously worked for another employer);
• documents confirming the sources of stable and regular income sufficient to cover the costs of living for you and your family members (for a single person - in the amount higher than PLN 701 net per month, for a person in a family - in the amount higher than PLN 528 net per month), e.g. PIT returns on the amount of income earned for the last tax year or an appropriate certificate from ZUS;
• documents confirming having insurance (e.g. appropriate certificate from ZUS, insurance policy).

A temporary residence permit and the decision obtained are not the end of the entire procedure. After obtaining the decision, you must wait about a few weeks for the issuance of a document such as a temporary residence card. Additionally, you will have to pay PLN 100 for issuing a residence card.

The temporary residence card gives you the right to legally stay in Poland for the period indicated in the decision. Based on this permit, you can stay in other EU countries for up to 90 days. A temporary residence card gives you the right to work only if you have received a uniform temporary residence and work permit, are a full-time student or have a temporary residence permit for the spouse of a Polish citizen.

If you come from a country outside the European Union and your visa or 90 days of visa-free stay are coming to an end, you must apply for a residence permit.

You cannot apply for a temporary residence and work permit, among others, if:

• you are a delegated employee;
• you run a business in Poland;
• you are staying in Poland for seasonal work;
• you are staying in Poland on the basis of a Polish visa issued for tourist purposes or to visit family or friends;
• you are staying in Poland for tourist purposes or to visit family or friends on the basis of a visa issued by another Schengen country;

How long is a temporary residence permit valid?

If you have a temporary residence permit to perform work in a profession requiring high qualifications, you can additionally perform work only in a profession requiring high qualifications.

If you are in visa-free travel, have a visa or temporary residence permit and a work permit, you can start working for a new employer if he obtains a new work permit for you.

However, you can apply to the voivode competent for your current place of residence to change the permit if you want to perform work:

• at another user's employer,
• in another position,
• for lower remuneration,
• in a different working time. If you want to change your employer, you must apply for a new temporary residence and work permit.

If you have a temporary residence permit to perform work in a profession requiring high qualifications and you have not worked in Poland for another 2 years, you cannot start working for another employer or under different conditions.

You can apply to the voivode competent for your current place of residence to change your permit if you want:

• work for another employer,
• change the position you are employed in,
• receive remuneration lower than specified in the permit.
